ITAR Exemptions
An eligibility workbook
A step-by-step method for non-US companies to test whether an ITAR exemption really applies — general exclusions, every condition, the evidence — and what stays controlled after it is used.
What this guide settles
- An exemption waives a licence, not the ITAR: every condition must be met, the §120.15 rules and the exemption’s own exclusions cleared, and the use recorded and cited or certified
- Items exported under an exemption remain defense articles; onward moves need their own approval or exemption
- §126.7 works among eligible parties in Australia, the UK and the US, with a separate route for support to their armed forces, outside the Excluded Technology List and below notification thresholds
- §126.5 covers Canadian government and Canadian-registered persons for end use in Canada; agreement exemptions cover only listed unclassified hardware and data within scope; §123.9(e) is an authorization, not an exemption
